California Proposition 65 Toxic Enforcement Act - Residents in other States

What is California Prop 65?

CA Proposition 65, a ballot initiative passed in the state of California 25 years ago, is a law unique to California. It requires all businesses and establishments to post warning signs because the food, drinks, paint on the walls, air, or products they sell contain any one of 935 chemicals that California has determined may cause cancer or reproductive harm. The warning signs and labels are meant to alert consumers of possible exposure before they frequent an establishment or purchase a product.

As a result, Californians regularly and routinely see warning signs and labels on thousands of buildings, restaurants, and common products – including household, outdoor, hobby, leisure, business supplies, and even gas, foods, and wines. Due to the nearly 1000 chemicals included on the list, most places and products are at risk of containing one or more of the target chemicals.

Why does the product I’ve bought contain a Warning?

In the USA, the same distribution channels serve all 50 states. Because businesses cannot predict exactly which product may end up being sold to someone in California, consumer products in the other 49 states may also display these warning labels. As a result, customers may see Prop 65 warnings in retail stores, mail order, and internet sales regardless of their location.

What chemicals are identified by California?

California’s Prop 65 list contains over 900 chemicals (as of 2015 and updated annually).

Why Chairs Carry This Warning

Some materials used in chairs, including certain fabrics, coated surfaces, and flexible components, may contain small amounts of chemicals such as Di(2-ethylhexyl)phthalate (DEHP). DEHP is sometimes used to increase the flexibility and durability of materials used in many consumer products.

Because DEHP is listed under California Proposition 65 as a chemical known to cause cancer, birth defects, and other reproductive harm, products containing trace amounts of it require a warning label when sold in California. Even though the levels in our products are typically very low, we issue this warning to comply with California law and ensure transparency for all our customers.
